Well, it seems that Roberts' recusal comment has spurred contoversy -- about whether it was made at all, and what Roberts actually meant by it.
Perhaps not surprisingly, it's a Republican Senator, John Cornyn of Texas, who's now claiming that when he asked Roberts on Monday whether there was "anything about your faith or religious views that would prevent you from deciding issues like the death penalty of abortion or the like," Roberts replied, "absolutely not."
Cornyn supposedly had this conversation with Roberts because he was concerned about recusal. As I said earlier, though, I still don't see it as a serious issue, except to the extent that it would (in part, at least) take some of the most difficult political issues out of the confirmation process. Other legal thinkers, such as Ann Althouse, believe Roberts' statement would have very limited applicability, anyway.
